Employers’ Obligation To Obtain And Maintain Coverage
Businesses covered by the North Carolina Workers’ Compensation Act, N.C. General Statute 97, are required by law to obtain insurance or qualify as self-insured to compensate injured workers. All businesses employing three (3) or more employees on a regular basis are covered, except for agricultural employments with fewer than ten (10) regular employees, certain sawmill and logging operators, and domestic employees which have been exempted from the coverage requirement. Businesses with any employee whose work takes place in the presence of radiation are required to have coverage. Corporate officer/employees are counted in determining whether the business has three or more employees. However, corporate officers, partners, and owners who are employed in the business may specifically exclude themselves from coverage under a workers’ compensation policy. Corporate officers of non-profit corporations that do no receive any compensation for their work are not covered under the Act, but do count towards the total number of employees. Sole proprietors and partnerships that have three (3) or more employees must purchase coverage for these employees and may elect to include coverage for themselves. Principal contractors must obtain a certificate of coverage from their subcontractors in order to avoid liability for injuries suffered by a subcontractor’s employees.
